PlayGM Terms of Service
These Terms are a contract between you — the adult who opens the household account — and PlayGM Inc. They govern your use of PlayGM. Please read them. Section 15 is a binding arbitration clause and a class-action waiver; you can opt out within 30 days as § 15.7 explains.
Your child does not agree to these Terms. You agree on their behalf, as their parent or legal guardian, and you are responsible for their use of PlayGM.
1. Who can use PlayGM
You must be at least 18 to open a household account. PlayGM is offered only in the United States. If you are outside the United States, do not create an account.
Every child who plays does so on a profile inside your household. Only you (and any adult you add) can create, change, or delete a child profile.
2. What we agree to provide
We provide the PlayGM app and website, the Ask Scout assistant, the physical card scanner, and the servers and services that make them work. We update the game over time. We aim to keep the service available but we do not promise it will be uninterrupted or error-free.
We agree not to expose your child to advertising, to third-party analytics or tracking, or to social interaction with strangers using free-form text. Our privacy commitments are in the Privacy Policy at {{PLACEHOLDER: URL of privacy policy}} and are incorporated into these Terms.
3. Your account
You are responsible for the security of your account credentials and for the household PIN. The PIN protects the parent surface from your child; it is not proof of identity to us and it does not substitute for our verification of a privacy request.
You may add other adults to your household. Any verified adult may take most actions on the account, with the exception that a delete request has additional safeguards (see the Privacy Policy § 11).
You may close the household account at any time. Closing the account deletes every child profile in it.
4. Payment
PlayGM is a subscription service. Prices, billing cycle, and cancellation terms are shown at purchase and in Settings → Subscription. Payment is processed by {{PLACEHOLDER: payment processor}}, which handles your payment information under its own terms; we do not store your card number.
You may cancel a subscription at any time from within the app. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods unless required by law or expressly stated otherwise.
No in-app purchases. PlayGM has no cash in-app purchases and no ticket purchases. The in-game ticket economy is earned through play; tickets have no cash value and cannot be bought, sold, or transferred outside the app.
5. Acceptable use
You agree that no one on your household will:
- Use PlayGM to threaten, harass, or defame anyone.
- Attempt to reverse engineer, decompile, or extract the source of the app, except where that right cannot be waived by contract under applicable law.
- Attempt to circumvent, disable, or interfere with the safety filters on Ask Scout or any other safety or verification feature.
- Use automated means to interact with PlayGM.
- Use PlayGM in violation of any law.
- Attempt to access anyone else's household or profile.
- Upload any content other than physical trading card scans processed on-device by the scanner. PlayGM does not accept user-uploaded photos, video, audio, or free text intended for other players.
We may suspend or close an account that violates this section, subject to our privacy obligations.
6. Ask Scout — what it is and what it is not
Ask Scout is a computer helper. It is not a person. Its answers are generated by a large language model and can be wrong, out of date, or incomplete. You should not rely on any Ask Scout answer for real-world consequences beyond enjoying PlayGM.
Ask Scout will only answer questions related to sports and to gameplay. It will refuse to discuss anything else, including mental health, self-harm, sexual content, and violence. If your child says something to Ask Scout that suggests they may be in danger, we will show your child crisis resources and notify you.
We do not save the questions your child types to Ask Scout. Details in the Privacy Policy § 4.
7. The card scanner
The card scanner runs entirely on your device. It recognizes the card and records only the identifier of the recognized card. Nothing about the image leaves the device. If your device does not support on-device processing at the required standard, we may disable the scanner.
8. What belongs to us and what belongs to you
PlayGM (the app, the website, the artwork we use for cards, our brand, "PlayGM," "Ask Scout," the palette we use, the audio, and everything else we create) belongs to PlayGM Inc. You may use it only through the app and website, for personal, non-commercial use. You may not copy, sell, sublicense, or modify it.
Your child's gameplay records (drafts, rosters, scores) belong to your household in the sense that we let you export them at any time. We keep a copy to run the game while your account exists.
No real athletes, teams, or leagues. PlayGM does not license, and does not use, the names, likenesses, photographs, uniforms, logos, colors, or other marks of any real athlete, team, or league. Any real-world names that appear are statistical references and not indications of association or endorsement.
Feedback. If you send us feedback or suggestions, we may use them freely. You are not owed compensation for a suggestion.
9. Content from Ask Scout
Because Ask Scout draws on general model output, we make no claim of ownership over the text it returns to you and we make no promise that any particular answer is accurate, complete, or original.
10. Third-party services
Some parts of PlayGM depend on services we do not run — for example, the app store you got PlayGM from, the internet service that connects your device, and the platforms we identify in the Privacy Policy § 8. Your use of those services is governed by their own terms. We are not responsible for their acts or omissions.
11. Availability, changes, and termination
We may change or discontinue any part of PlayGM. If a change materially reduces what we offer, we will give you notice and, if you are on a paid subscription, a fair way to end it.
We may suspend or terminate your account for material breach of these Terms, for prolonged inactivity as described in the Retention Policy at {{PLACEHOLDER: URL of retention policy}}, or where we reasonably believe continued service would violate the law or harm another user. Where a termination is not for breach or law-enforcement reasons, we will give you reasonable notice and an opportunity to export your child's data.
You may end these Terms at any time by closing your account.
Sections that by their nature should survive termination (payment obligations for services already rendered, IP ownership, disclaimers, limitation of liability, arbitration and class waiver, and this survival clause) survive.
12. Disclaimers
PlayGM is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade.
We do not warrant that PlayGM will be uninterrupted, free of harmful components, error-free, or that any defect will be corrected. Ask Scout's answers are model output and are not a source of truth.
Nothing in this section limits your rights that cannot be limited under applicable consumer law.
13. Limitation of liability
To the maximum extent permitted by law:
- Neither party is liable to the other for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or relating to these Terms or PlayGM.
- Our total liability to you for any claim relating to PlayGM will not exceed the greater of (a) the amount you paid us for PlayGM in the 12 months before the event giving rise to the claim, or (b) US$100.
These limits do not apply to liability that cannot be limited under applicable law, including personal injury caused by our negligence or willful misconduct, our indemnification obligations, or our misuse of your child's personal information.
14. Indemnification
You will defend, indemnify, and hold harmless PlayGM Inc, its officers, directors, employees, and agents from any third-party claim arising out of (a) your material breach of these Terms, (b) your misuse of PlayGM in violation of § 5, or (c) content you or your household submitted in violation of these Terms. We will notify you promptly of any claim and let you control the defense with counsel of your choice, subject to our reasonable approval, and cooperate with you at your expense. You may not settle any claim in a way that admits fault on our behalf or that imposes any obligation on us without our written consent.
15. Dispute resolution — please read carefully
15.1 Informal resolution first
Before starting a formal proceeding, you agree to write to us at stefan@playgm.app describing the dispute and what you want, and give us 30 days to try to resolve it. This does not toll any deadline that would otherwise apply.
15.2 Binding arbitration
If we cannot resolve the dispute informally, any dispute between you and PlayGM Inc arising out of or relating to PlayGM or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator, not any court, decides all issues of interpretation and enforceability of this arbitration agreement, except that a court decides whether § 15.4 (class waiver) is enforceable.
15.3 Where and how
The arbitration will be conducted in the county where you live, or by telephone or video at your election. We will pay the AAA filing fee that exceeds what you would have paid to file in small-claims court. Each party otherwise bears its own attorneys' fees unless a statute or rule provides otherwise.
15.4 Class action waiver
You and PlayGM Inc agree that any dispute will be resolved individually. Neither party may participate in a class action, class arbitration, private attorney general action, or other representative proceeding. If a court finds this waiver unenforceable in whole or in part, that portion of the dispute proceeds in court and the rest remains in arbitration.
15.5 Small claims carve-out
Either party may bring an individual claim in a small-claims court with jurisdiction. Neither party has to arbitrate a small-claims matter.
15.6 Injunctive relief carve-out
Either party may seek injunctive or equitable relief in court to protect intellectual property or confidential information.
15.7 Your right to opt out
You can opt out of § 15.2 and § 15.4 within 30 days of first accepting these Terms by emailing stefan@playgm.app with the subject line "Arbitration Opt-Out" and your account email. Opting out does not affect any other provision. If you opt out, disputes will be resolved in the courts described in § 16.
15.8 Changes
If we materially change this § 15 in the future, you can reject the change by emailing us within 30 days of the change, and the prior § 15 will continue to apply to disputes with you.
15.9 30-day window
Notwithstanding any statute of limitations to the contrary, a dispute must be brought within one year of the event on which it is based, or it is waived, except where a longer period is required by applicable law.
16. Governing law and venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles, and by applicable federal law. Where § 15 does not apply (small claims, opt-outs, injunctive relief), the state and federal courts located in New Castle County, Delaware have exclusive jurisdiction, and you consent to the personal jurisdiction of those courts.
Nothing in this section overrides consumer-protection rights that applicable law gives you in your state of residence.
17. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between us on this subject and supersede any prior agreement.
- No assignment by you. You may not assign these Terms without our consent. We may assign to an affiliate or a successor in a merger, sale, or reorganization.
- Severability. If a provision is unenforceable, the rest continues in effect and the unenforceable provision will be modified to the minimum extent necessary to be enforceable.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Notices. We may notify you by email to the address on your account or by in-app notice. You may notify us at the addresses in § 18.
- Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control.
- No third-party beneficiaries. These Terms do not create rights in anyone other than you and PlayGM Inc.
- Interpretation. "Including" means "including without limitation." Section headings are for convenience.
- US export. You represent that you are not on any US sanctions or export list and will not use PlayGM in violation of US export laws.
